Governing terms for Gulia Brothers Pty Ltd. Please read these carefully before engaging our services.

1. Parties
These Terms of Use apply to the website (guliabrotherstec.site) and the supply of commercial and trade services by Gulia Brothers Pty Ltd (ABN 97 699 845 111, ACN 699 845 111), a company registered in Western Australia, with a registered place of business at WA 6112, Western Australia.

3. Services
Subject to these Terms, we agree to provide commercial and trade services (including but not limited to building, maintenance, renovation, fit-out, project management, and advisory services) with reasonable care, skill, and diligence. Any quote we provide is not an offer and we reserve the right to withdraw or revise it at any time before acceptance.
4. Quotes, pricing & payment
All quotes are in Australian dollars and remain valid for 30 days unless stated otherwise. Payment is due in accordance with the payment terms agreed in writing with you. We may charge interest on overdue amounts at the statutory rate. We reserve the right to suspend or withhold performance until payment is received in full.
5. Australian Consumer Law (ACL)
Nothing in these Terms excludes, restricts, or modifies any guarantee, warranty, or remedy provided by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be lawfully excluded, restricted, or modified. If you are a consumer under the ACL, you benefit from the statutory guarantees that our services will be provided with due care and skill, fit for purpose, and with due care and diligence.
6. Your obligations
When engaging our services, you must provide accurate and complete information, obtain all necessary approvals, permissions, and approvals (including any third-party consents) for the work, and ensure safe access to the site. You must pay the agreed charges on time.
7. Intellectual property
All content on guliabrotherstec.site (including text, graphics, logos, and layout) is the property of Gulia Brothers Pty Ltd or used with permission, and is protected by Australian and international copyright and trade mark laws. Except as expressly permitted in writing, you may not reproduce, distribute, modify, or create derivative works from the website content. Nothing on the website grants you any right, title, or interest in the website or its content.
8. Limitation of liability
To the maximum extent permitted by law, including the Australian Consumer Law:
- Our total aggregate liability for any claim arising out of or related to these Terms or our services, whether in contract, tort (including negligence), statute, or otherwise, is limited to the total amount paid by you to us under the relevant engagement.
- We will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or any loss of profits, revenue, data, or opportunity, even if we have been advised of the possibility of such damages.
- We will not be liable for any delay or failure to perform our obligations caused by circumstances beyond our reasonable control (an event of force majeure).
9. Insurance & warranties
We carry professional indemnity and public liability insurance as required by law. Any warranty we provide in relation to work performed is set out in the written scope and is in addition to any rights you have under the ACL. We do not provide any express warranty beyond that agreed in writing.
10. Termination
Either party may terminate an engagement by giving written notice to the other party, subject to settlement of outstanding amounts. Upon termination, you must pay us for all work performed and expenses incurred up to the effective date of termination. Sections 5 (ACL), 7 (IP), 8 (Limitation of liability), 10 (Termination), and 11 (Governing law) survive termination.
11. Governing law & jurisdiction
These Terms of Use are governed by and construed in accordance with the laws of Western Australia, and the courts of Western Australia have non-exclusive jurisdiction to determine disputes arising out of or in connection with these Terms. This clause is subject to any non-excludable rights provided under the ACL and the Privacy Act 1988 (Cth).
12. Changes to these terms
We may update these Terms of Use from time to time. When we do, we will publish the updated version on guliabrotherstec.site with a revised "Last updated" date. Your continued use of the website after any change constitutes your acceptance of the new Terms.
